Rome Statute   Peru signed the Rome Statute on 7 December 2000, and ratified on 10 November 2001, becoming the 44th State Party.
Agreement on Privileges and Immunities Peru signed the Agreement on Privileges and Immunities on 10 September 2002.
Bilateral Immunity Agreement Publicly rejected BIA agreement.
Implementing Legislation On February 1st, 2006 the Chapter on Judicial Cooperation with the ICC of the new Code of Criminal Procedures came into force. This Chapter includes provisions on internal procedures for the detention and surrender of individuals to the ICC, among other forms of cooperation with the Court. With this initiative, Peru became the first country in the region to adopt specific cooperation legislation with the ICC.

Regarding crimes included within the Rome Statute, a technical ad hoc- Parliamentarian commission (Comisión Especial Revisora del Código Penal) was set up in October 2002 to draft a new Criminal Code including RS crimes. The bill was introduced in the Justice and Human Rights Commission, but lack of political will and other priorities delayed its consideration.

During the congressional period (2006-2011), efforts continued to be carried out in order to approve the bill as an independent law (PL 1707) and no longer as part of the entire Criminal Code. Nevertheless, despite consistent advocacy, the Bill was not approved by the Justice and Human Rights Commission and once again did not reach the plenary for consideration.

Given the establishment of a new Congress in July 2011, some of the MPs of the Justice and Human Rights Commission are trying to generate multi-party support to push for a new independent law based on the original bill PL 1707 that had already received favorable support from members of the prior legislature’s Justice and HR Commission.
