| Loi de mise en oeuvre |
Coopération : Le 29 mars 2004, la loi belge de coopération avec la CPI et les Tribunaux Internationaux a été approuvée. Elle a été publiée le 1er avril et est disponible sur www.moniteur.be
Complémentarité : Selon la nouvelle loi, adoptée le 5 aoùt 2003, les Cours belges auront compétence pour les crimes internationaux si l’accusé est belge ou s’il a sa résidence principale en Belgique, si la victime est belge ou si elle habitait en Belgique depuis au moins trois ans au moment de la commission du crime, enfin si un traité donne compétence à la Belgique pour résoudre l’affaire. Selon l’article 12 bis du chapitre préliminaire du Code de Procédure Pénale, les juridictions belges restent compétentes pour toutes les questions de droit international humanitaire si l’accusé se trouve sur le territoire belge et ce, même lorsqu’il n’existe pas d’autres connexions avec la Belgique, à moins qu’il ne soit détenteur d’une immunité internationale selon la CIJ (Cour Internationale de Justice). La nouvelle loi a également considérablement réduit la possibilité pour les victimes d’accéder aux Cours, hormis lors des situations énoncées ci-dessus.
