A representative of Israel’s Ministry of Foreign Affairs attended the third Assembly of States Parties at the Hague and mentioned that Israel still have concerns with Rome Statue and will observe development of the International Criminal Court before taking any steps.
In June 2002, Israel formally announced that it has no intention to ratify the Rome Statute. After the Rome Conference, Israel indicated a more open attitude towards the Court. The following are/have been Israel's primary issues of concern: According to the Israeli government, the inclusion of settlement activity as a "war crime" has no basis in international law. The inclusion of this provision (Article 8, Paragraph 2(b), sub-para viii), Israel's most significant concern, was largely resolved through the negotiations on the Elements of Crimes at the UN Preparatory Committee. Israel also expressed concern over several issues, including a State's right to withhold from the Court information or documents that could prejudice its national security interests, as well as the principle of equitable geographical representation in selecting the judges of the Court (which it feels would give little hope for the election of any Israeli candidate). |
