Despite positive statements made in early 2004 by the Executive, ratification of the Rome Statute in Jamaica is still pending. Consistent with its status as a common law country, implementing legislation is required if the Rome Statute is to become part of the laws of Jamaica.
On 18 February 2004, Minister of Justice and Attorney-General A. J. Nicholson said that the Government of Jamaica intends to ratify the Rome Statute. This announcement was made in a workshop hosted by the Ministry of Justice and the Ministry of Foreign Affairs and Foreign Trade, in collaboration with the International Centre for Criminal Law Reform and Criminal Justice Policy. In 2003, an Inter-Ministerial Commission on the Rome Statute composed by representatives from the office of the Director of Public Prosecutions, the office of the Chief Parliamentary Counsel, the Office of Legal Reform, the MOFA, the Ministry of National Security and chaired by a representative from the AG Chambers met over several months to analyze the implications and concerns regarding ratification of the Statute. A cabinet submission seeking authorization for RS ratification was prepared but has not been presented to Cabinet as some policy directives remain outstanding. |
