Informal Summaries of Proceedings [Darfur Case 2 May - 11 May 2007 / Darfur Situation 11 May 2007]
Please find below an informal summary of developments at the ICC on the
Harun and Kushayb Darfur Case and on the Situation of Darfur/ Sudan made
public between 2 and 11 May 2007. The Darfur Situation was referred to the
Prosecutor by the UN Security Council on 31 March 2005. On 1 June 2005, the
Prosecutor opened investigations. The Case of Harun and Kushayb was
initiated with the issuance of arrest warrants of 27 April 2007. Case and
situation have been assigned to Pre-Trial Chamber I (PTC I).
Due to the increased activities at the Court, the Coalition distributes
frequent summaries (as below) as part of its mandate to provide information
about the Court. Comments, corrections and questions on these summaries are

HARUN & KUSHAYB CASE

DECISION ON THE PROSECUTION APPLICATION UNDER ART.58 (7) OF THE STATUTE
On 27 April 2007, after having been seized of the Prosecution's Application
dated 27 February, PTC I decided to issue warrants of arrest for Ahmad Harun
and Ali Kushayb for their alleged responsibility for crimes against humanity
and war crimes. The decision set out that the case against Harun and Kushayb
fell within the jurisdiction of the Court and was admissible. It further
stated that there were reasonable grounds to believe that the crimes
described in the Application have been committed and that there were also
reasonable grounds to believe that Harun and Kushayb were criminally
responsible for the crimes. Based on the information provided by the
Prosecution, PTC I was not satisfied that summons to appear were sufficient
to ensure Harun's and Kushayb's appearance before the Court and therefore
issued arrest warrants instead. PTC I also decided that the Registry shall
prepare two requests for cooperation seeking the arrest and surrender of
Harun and Kushayb.

WARRANT OF ARREST FOR AHMAD HARUN
On 27 April 2007, PTC I issued a warrant of arrest for Ahmad Muhammad Harun
who served as Minister of State for the Interior of the Government of Sudan
from April 2003 until September 2005 and as Minister of State for
Humanitarian Affairs since 2006 in the present Government of Sudan. PTC I
held that there were reasonable grounds to believe that Harun was criminally
responsible for the commission of crimes against humanity and war crimes,
including persecution, murder, attacks against civilian population,
destruction of property, forcible transfer, rape, inhumane acts, pillaging,
imprisonment or severe deprivation of liberty, torture and outrage upon
personal dignity. PTC I listed 42 counts involving incidents in the period
between August 2003 and March 2004. PTC I held that there were reasonable
grounds to believe that Harun, as result of his position at the "Darfur
Security desk" and thereby coordinating the different bodies of the
government involved in the counter-insurgency, had knowledge of the crimes
committed but also personally encouraged commission of criminal acts.

WARRANT OF ARREST FOR ALI KUSHAYB
On 27 April 2007, PTC I issued a warrant of arrest for Ali Kushayb who
allegedly has been one of the top commanders of the Militia/Janjaweed and is
believed to be currently in the custody of the Sudanese Police for unrelated
charges. PTC I held that there were reasonable grounds to believe that
Kushayb was criminally responsible for the commission of crimes against
humanity and war crimes, including persecution, murder, attacks against
civilian population, destruction of property, forcible transfer, rape,
inhumane acts, pillaging, imprisonment or severe deprivation of liberty,
torture and outrage upon personal dignity. PTC I listed 50 counts involving
incidents in the period between August 2003 and March 2004. PTC I held that
there were reasonable grounds to believe that Kushayb intentionally
contributed to the commission of the mentioned crimes and also participated
personally in a number of incidents.
