The Criminal Code of Serbia that entered into force in January 2006 has incorporated the substance of the Rome Statute provision regarding the crimes under its jurisdiction with some minor differences.

A working group under the Ministry of Justice is currently drafting a Law on International Legal Assistance in Criminal Matters which will cover international legal aid in criminal matters in general, including co-operation with the ICC.

The recent adopted constitution of Serbia has lifted all bans to extradition.

The Parliament approved the text of the ratification act on 22 June 2001 and the President signed it on 6 September 2001.

In regards to Kosovo as of April 2003, the United Nations Interim Administration for Kosovo has drafted a Criminal Code and a Criminal Procedural Code. The Criminal Code defines war crimes and introduces new offences, such as crimes against humanity. Both Codes incorporate the criminal offences defined in international conventions, including the Rome Statute of the ICC.
