The Libyan government has a legal committee that has been closely following developments at the ICC. It is also preparing Libya’s input on the crime of aggression and other issues to be covered during the Review Conference in 2010. Libya has concerns about the Rome Statute provision that allows for Security Council referral of situations to the ICC because of the risk of the practice of ‘double standards’ in the Council’s selection of referrals. Libyan delegates at the UN and some Libyan professors of international law have expressed their support for the ICC and their optimism that Libya will eventually become a State Party. Libya has been attending the ASP and resumed ASP sessions as an observer.
