Malawi ratified on 9 September 2002, becoming the 81st State Party.

As of October 2002, the government was in the process of enacting cooperation legislation, which had to be introduced to the Cabinet.

The ratification process may have required constitutional amendment.

To assist SADC Member States in enacting legislation, a Southern African Development Community meeting held in Pretoria, South Africa, 5-9 July 1999 adopted a model-enabling-law that each state could adapt to their national situations. This model law covers virtually all aspects of the ICC Statute that require state action and cooperation.
