Niger ratified on 11 April 2002, participating in the simultaneous deposit at the special UN treaty ceremony to mark the 60 ratifications necessary for entry into force.

The legislative process was earlier disrupted by a coup in April 1999. Until the elections in December of 1999, ratification was on hold. Sources indicated that the Ministry of Foreign Affairs had waited to send a report to the government and Parliament until they learned about progress of the Preparatory Commission. There was a positive attitude towards the Rome Statute in the National Assembly and among the leaders of the main political parties.
