As of September 2002, political will existed to ratify the Rome Statute promptly, and constitutional concerns were reportedly to be resolved without constitutional amendment.
The ratification bill was before the Council of Ministers (Cabinet) for review. Once approved, the bill was supposed to proceed to the National Assembly and President for consent. The issue of immunties had been problematic, but an interpretive approach may be possible after information obtained at the May 2001 SADC meeting. To assist SADC Member States in enacting legislation, a Southern African Development Community meeting held in Pretoria, South Africa, 5-9 July 1999 adopted a model-enabling-law that each state could adopt and adapt to their national situations. This model law covers virtually all aspects of the ICC Statute that require state action and cooperation. |
