As of September 2002, there were indications that ratification of the Rome Statute was under consideration, since inter-ministerial work was being undertaken in order to submit the ratification bill to the Duma for approval. However, sources report that ratification was not on the Duma’s legislative agenda for the fall of 2002.
The Criminal Code and Criminal Procedural Code must be adapted to include crimes under the Rome Statute. Cooperation legislation must also be incorporated into implementing legislation. On 6 May 2002, the chairman of the State Duma Committee for Legistlation and former Justice Minister Pavel Krasheninnikov, spoke in favor of Russia’s ratification of the Rome Statute (in an interview with Ekho Moskvy Radio). State Duma deputy speaker Vladimir Lukin stated, "I’m deeply convinced that we should ratify the [Rome] Statute without looking at the US stance. We should carry out not pro-American or anti-American policy, but pro-Russian policy, proceeding from our own views and beliefs." A comparative study of national legislation and provisions of the Rome Statute was conducted. The problems raised include: constitutional issues; material criminal law; and cooperation with the Court. With regard to surrender and extradition, a legal study concluded that no constitutional amendments are required. |
