On 20 June 2005, President Vazquez. together with the Presidents from all MERCOSUR Member States', adopted a Declaration entitled "Committment of the MERCOSUR to the Rome Statute of the International Criminal Court", in which they highlighted the importance and scope of the Rome Statute. They also adopted a common position regarding the provision of Article 98 of the Rome Statute by committing themselves "not to undertake multilateral or bilateral agreements with Third States, that could effect the basis of the jurisdiction of the International Criminal Court or other provisions of the Rome Statute".
Due to some problems with the government’s prior ICC implementing bill, the Ministry of Education and Culture took the initiative to hire an independent consultant to draft a new ICC implementation bill that would address some of the inconsistencies present in the original government Bill. The draft prepared by the consultant was presented to civil society for comments on May 19th, 2005. The Bill is currently undergoing a consultation process. The government initiative to implement the Rome Statute passed in the Senate in early 2004, but it has not been approved by the Chamber of Deputies. On 22 January 2003, draft implementing legislation was submitted to the Constitutional and Legislative Commission of the Senate. On 18 January 2003, the President submitted draft implementing legislation to Congress for approval. This legislation, prepared by the Ministry of Justice, includes all crimes under the Rome Statute as well as cooperation with the Court. In 2 May 2002, the Executive Branch submitted the ratification bill to Parliament. The Supreme Court then declared that a constitutional amendment would not be necessary as interpretation of the treaty can resolve concerns regarding immunities and amnesties. Previously, on 20 July 2000, a member of Parliament presented a formal statement to the Speaker of the Chamber of Deputies to request that the Minister of Foreign Affairs provide information about actions taken by the Ministry to analyze the Rome Statute and begin steps towards signature and ratification. |
