Updates on Bosnia and Herzegovina

The Office of the High Representative of Bosnia and Herzegovina enacted a new Criminal Code and Criminal Procedural Code on 24 January 2003, which entered into force on 1 March 2003. These codes are part of the overall reform of the judiciary in Bosnia and Herzegovina, that comprises a new State Ministry of Justice, a State Court with a special war crimes department, and a State Prosecutor with competence for war crimes, genocide and crimes against humanity. The definitions of these crimes in the new Criminal Code are set in Chapter XVII on "Crimes against Humanity and Values Protected by International Law"- articles 171-203.

The Rome Statute was ratified by the President on 5 February 2002, and the ratification bill was published in the official gazette on 6 March 2002. Ratification entered into force at the domestic level on 14 March 2002.

Prior to the President's signature, it was necessary to obtain the signature of the Chair of the Chamber of Peoples of the Bosnia and Herzegovina Assembly.
