International Criminal Court's investigation in Kenya.

Please take note of the Coalition's policy on situations before the ICC (below),
which explicitly states that the CICC will not take a position on potential and
current situations before the Court or situations under analysis. The Coalition,

"At the conclusion of the 16th Summit of the African Union (AU), the AU issued a
decision on the International Criminal Court (ICC), which adopts a negative
stance on justice, including endorsing a request by Kenya to the United Nations
Security Council (UNSC) for a deferral of the Court's investigation and
maintaining its call on African states not to cooperate with the ICC. Civil
society expresses its disappointment and calls on Kenya and the African Union to
uphold its commitment to justice, the Coalition for the International Criminal
Court (CICC) said today....

'This decision of the AU is contrary to the supportive role adopted by
individual African States parties, who have clearly stated their commitment to
the ICC and to justice,' said Stephen Lamony, the Coalition's Africa Outreach
Liaison and Situations Adviser.... 'The AU should have a consistent position on
justice akin to those of its Members: justice for all serious international
crimes, whether by a national, regional or international court,' he added....

'The government of Kenya squandered a great opportunity to show the world that
it was committed to justice,' said Oby Nwankwo, Executive Director of the Civil

"On December 15, 2010, International Criminal Court (ICC) prosecutor Luis
Moreno-Ocampo requested summonses to appear against six Kenyan citizens for
crimes against humanity alleged to have been committed during the post-election
violence in Kenya in 2007-08....

Although the prosecutor's application for summonses was widely welcomed by both
local and international civil society, the Kenyan parliament passed a motion on
December 22, 2010, urging the government to withdraw from the Rome Statute, the
ICC's founding treaty....

It is in this regard therefore that we, the undersigned civil society
organizations, urge the Kenyan government and parliament to reaffirm their
support for the ICC and put a stop to any attempts to undermine the Rome Statute
system and the ICC's Kenya investigation, including through withdrawal or
seeking deferral. We also urge the Kenyan government-in particular the President
and the Prime Minister-to clarify its position with regard to the Rome Statute
more broadly, and its obligations to cooperate with the ICC in the cases
currently before the court.

Kenya's withdrawal from the Rome Statute would mark a severe break with its
commitment to the fight against impunity....

African governments, together with civil society, played an active role in
establishing the court. We therefore call on our governments to stand firm in
their support for the ICC, and reject steps which would undermine the court at
the upcoming AU summit. Instead, African ICC states parties should build on
important achievements to date and continue to advance justice for victims of
human rights violations, including victims in Kenya. The AU's Constitutive Act,
in article 4, calls for, among other things, the rejection of impunity. The ICC
is an integral component of this effort."

"International Criminal Court (ICC) is not a court of convenience, to be
supported only when it is politically expedient....

Rather than opposing the Court's work, Kenya and African Union could better
address its unease by ensuring closer coordination among African governments,
the ICC and the United Nations to make sure the Court works well and addresses
Africa peoples' concerns....

We believe the Court will help to end high-level impunity for mass atrocities,
enabling Kenya to attain the best Kenyans are capable of. "Peace before justice"
argument serves to perpetuate impunity. Unless indicted war criminals are held
to account, regardless of their rank, others tempted to emulate them will not be
deterred, and African people will suffer....

In this regard, we are urging the United Nations Security Council to vehemently
disregard African Union resolution to support attempts at deferring Kenya
situation. Instead we are advising the Council to encourage Kenya to engage
directly with the Court through the mechanisms set out by the Rome Statute."

"The President of the Assembly of States Parties to the Rome Statute of the
International Criminal Court, H.E. Mr. Christian Wenaweser, visited Kenya from
27 to 28 January 2011 in order to hold consultations on ICC issues.

During his two-day visit, President Wenaweser met the President of Kenya, H.E.
Mr. Mwai Kibaki, members of the Cabinet's Committee on the ICC...as well as
other senior Government officials and members of Parliament. Ambassador
Wenaweser also met with members of the diplomatic community and various civil
society groups as well as the Kenya National Commission on Human Rights....

He also welcomed the cooperation that the Government of Kenya had extended to
the Court in its activities in the country along with the continued cooperation
extended by the Government, as expressed during a recent visit of a technical
team of the ICC to Nairobi.

With respect to the expressed intention of the Government to establish, on the
basis of its new constitution, national proceedings to investigate and prosecute
serious crimes allegedly committed, including in the context of post-election
violence, President Wenaweser emphasized the principle of complementarity....

With regard to reports of diplomatic initiatives aimed at seeking a suspension
of the judicial proceedings of the Court via the United Nations Security
Council, President Wenaweser expressed the concern that such a request would
implicitly be interpreted as a statement that the situation in Kenya constituted
a threat against international peace and security and put the issue before a
political body instead of having it considered by the judges of the Court.

The Government of Kenya reiterated its commitment to the Rome Statute and its
membership therein. As regards the principle of complementarity, the Government
noted that it was moving as expeditiously as possible with the implementation of
the police and judicial reforms mandated by the new Constitution, which would
allow national proceedings to be undertaken by the Kenyan judiciary, within the
framework of the Rome Statute."

"The African Union Summit drew to a close today in the Ethiopian capital, Addis
Ababa. Among the headline decisions was the continental body's support for
Kenya's planned request to defer prosecution by the International Criminal Court
(ICC) of six suspects in post-election violence that claimed more than 1,200
lives in 2008....

Stephen Lamony, the Outreach Liaison for the Coalition for the International
Criminal Court (CICC) told IPS many African governments were uncomfortable
attending the Summit alongside the indicted Bashir.

...Lamony added [that] neither the endorsement of Kenya's plan to seek deferment
nor similar actions regarding Bashir should be construed as a waning of support
by African governments for the International Criminal Court.

'The Court is investigating and prosecuting crimes committed against African
victims only when the states where the crimes were committed have been unable or
unwilling to do so. Following referrals by states and the United Nations
Security Council and more recently on the Prosecutor's initiative, the ICC
Prosecutor has opened investigations in five situations.'

He called on African governments - as well as civil society and the public - to
remain committed to the ICC and the rule of law.

'In the past decade alone, millions of Africans have lost their lives in
conflicts and have been the target of war crimes, crimes against humanity, and,
arguably, genocidal campaigns perpetrated against them. By attempting to punish
those responsible for these crimes, the Court is standing up for African victims

governments, together with civil society, played an active role in establishing
the International Criminal Court.'

"...Briefing media at the Intercontinental Addis Hotel yesterday evening
(January 26, 2011) here in Addis Ababa, representatives of various civil
societies from different African countries urged AU to engage in a dialogue with
the ICC and facilitate the establishment of ICC office in the African capital.

'We are not requesting the opening of office in Addis Ababa to arrest African
leaders who committed crime against humanity. I am optimistic that those who are
wanted by ICC will be arrested one day,' said Stephen A. Lamony, Africa Outreach

Speaking on the need Africa's need for ICC, Mr. Lamony stressed that the ICC is

"Kenyans last week watched in dismay as African Union Commission chairman Jean
Ping assured Vice President Kalonzo Musyoka of the AU's support for Kenya's bid
to seek a deferral on the post-election violence cases being considered by the
International Criminal Court....

The response by the AU chair was disturbing, first because an Article 16
deferral under the Rome Statute can only be sought where there is a threat to
the peace and security of a country.

No such threat was invoked by Kenya's vice president during the meeting....

In an effort to retaliate and mount pressure on the UN Security Council to
respond to its requests, irrational decisions hitting at the ICC have
characterised AU Summits in the recent past with the most irrational one so far
being the resolution passed at the Summit held in July 2009, calling on African
State Parties to the Rome Statute to weigh their obligations to the AU in
comparison with those of the Rome Statute....

Seeking a deferral on the Kenyan case at this point in time would be a doomed
exercise from the onset. This is because Kenya's peace and security have been
bolstered by all the ICC initiatives conducted to date seeking to bring
accountability for the post-election violence.

It is an open secret that a majority of Kenyans support the ICC process and
opinion polls conducted just after the ICC prosecutor announced the six suspects
he preferred charges against indicated that 87 per cent of Kenyans had
confidence that justice would be served through the ICC process....

In any event, this is not the first time the government is discussing how the
post-election violence perpetrators would be tried locally; this has been their
talk for the past three years. There has been no political will to actually
establish such a trial process....

The AU should advise the Kenya government to challenge the International
Criminal Court's jurisdiction under Article 19 of the Rome Statute on the
grounds that it is genuinely willing and able to prosecute cases domestically."

CICC's policy on the referral and prosecution of situations before the ICC:

The Coalition for the ICC is not an organ of the court. The CICC is an
independent NGO movement dedicated to the establishment of the International
Criminal Court as a fair, effective, and independent international organization.
The Coalition will continue to provide the most up-to date information about the
ICC and to help coordinate global action to effectively implement the Rome
Statute of the ICC. The Coalition will also endeavor to respond to basic queries
and to raise awareness about the ICC's trigger mechanisms and procedures, as
they develop. The Coalition as a whole, and its secretariat, do not endorse or
promote specific investigations or prosecutions or take a position on situations
before the ICC. However, individual CICC members may endorse referrals, provide
legal and other support on investigations, or develop partnerships with local
and other organizations in the course of their efforts.
