Please find below information about recent developments related to the International Criminal Court's (ICC) investigation in Kenya. On 8 September 2011 and 5 October 2011 respectively, confirmation of charges hearings ended in the two cases in the Kenya situation: The Prosecutor v. William Samoei Ruto, Henry Kiprono Kosgey and Joshua Arap Sang; and The Prosecutor v. Francis Kirimi Muthaura, Uhuru Muigai Kenyatta and Mohammed Hussein Ali. Judges can confirm the charges and send the case to trial; reject the charges, or request the prosecutor for additional information. Pre-Trial Chamber II is expected to take a decision within 60 days of the closing of the confirmation hearings. This message includes the latest statements from the ICC (I) members of the Coalition for the International Criminal Court (II), related news and opinions (III), and audiovisual resources (IV). Please take note of the Coalition's policy on situations before the ICC (below), which explicitly states that the CICC will not take a position on potential and current situations before the Court or situations under analysis. ICC STATEMENT "Kisumu: Registry and the common legal representative for victims consult with Kenyan victims ahead of the Confirmation of Charges Hearing in the case The Prosecutor v. Francis Kirimi Muthaura, Uhuru Muigai Kenyatta and Mohammed Hussein Ali before the International Criminal Court (ICC). Some of the main issues addressed included the victims' concerns for their security, clarity on the issue of reparations for the victims and the continuing plight of the internally displaced. In line with Pre-Trial Chamber II's order of 26 August 2011, Mr Anyah led the early September consultations with assistance from the Victims Participation and Reparations Section (VPRS) of the ICC Registry, and organised it in conjunction with civil society organisations in Kenya. As Mr Anyah recently replaced a number of former legal representatives of the victims, the meetings were also an occasion for VPRS to explain to the victims the reasons for this change, and to explain the process by which he was appointed the common legal representative. A key objective of the consultations was to confirm whether or not the victims consented to having their identities disclosed to the Defence or the public. Citing tensions in the areas affected by the post-election violence, all of the victims consulted requested that their anonymity be maintained. The victims were also concerned about their lack of visibility as Internally Displaced Persons (IDPs), given that most of the victims in this case had returned to their "ancestral homes", and therefore had not been considered or given compensation packages by the Kenyan Government. Indeed, one victim likened being an IDP in Kenya "as similar to being disabled". In response Mr Anyah explained the reparations regime available through the ICC and also highlighted relevant limitations, ensuring that the victims were aware that reparations may be awarded only in the case of a conviction and at the end of the trial, and that the process could take years to complete. In addition to these direct consultations with the victims, VPRS also conducted training exercises with relevant civil society organisations in Kenya that have been working to help facilitate victim participation in one or the other cases before the Court. At present, 233 victims have been authorised by Pre-Trial Chamber II to participate in the proceedings in the case against Mr Muthaura, Mr Kenyatta and Mr Ali. "ICC: Pretrial Hearing for Second Kenya Case" Human Rights Watch, 21 September 2011, http://www.coalitionfortheicc.org/documents/ICC_-_PretrialKenya2011_09_21.pdf "(The Hague, September 21, 2011) - A "confirmation of charges" hearing to determine whether the second case in the Kenya situation at the International Criminal Court (ICC) should be sent to trial will begin on September 21, 2011, before an ICC pretrial chamber in The Hague. The hearing is expected to conclude by October 5. In this Kenya case, the ICC prosecutor has accused Francis Kirimi Muthaura, Uhuru Muigai Kenyatta, and Mohammad Hussein Ali of committing crimes against humanity during Kenya's 2007-2008 post-election violence. All three men were government officials at the time of the violence. Muthaura is the head of the public service and secretary to the cabinet, while Kenyatta is the deputy prime minister and finance minister. Ali was the Kenyan police commissioner at the time of the violence. They are accused of violence toward backers of the then-opposition Orange Democratic Movement. A confirmation of charges hearing in the first Kenya case was held earlier this month. In that case, William Samoei Ruto, Henry Kiprono Kosgey, and Joshua arap Sang face charges of crimes against humanity also allegedly committed during the post-election violence. They are accused of violence against supporters of President Mwai Kibaki's Party of National Unity. Decisions in both cases are expected by the end of the year. "Kenyans were glued to their TV sets and radios during the ICC hearing earlier this month in the case against Ruto, Kosgey and Sang," said Elizabeth Evenson, senior international justice counsel at Human Rights Watch. "They will now have the chance to hear the prosecutor's case against Kenyatta, Muthaura, and Ali. Kenyans will then wait eagerly for the judges to decide whether to send these cases to trial." The hearing is not a trial and will not determine the guilt of Muthaura, Kenyatta, or Ali. Instead, the limited purpose is to allow the judges to evaluate whether the prosecutor has enough evidence to move ahead with a trial. The defendants will have the opportunity to object to the charges, challenge the prosecutor's evidence, and present their own evidence. The defendants have indicated that they each intend to call witnesses. Kenyatta is expected to testify. Under the court's innovative system allowing for victim participation, 233 victims have been authorized to participate in the hearing through a common legal representative. On behalf of these victims, the legal representative may make opening and closing statements and may also seek the court's permission to question witnesses and provide written submissions. The Kenya investigation - the ICC's fifth - was opened in March 2010 after the prosecutor received authorization from the court. The CICC is an independent NGO movement dedicated to the establishment of the International Criminal Court as a fair, effective, and independent international organization.
