As of April 2004, the government had begun the process of drafting implementating legislation. A law on cooperation was approved by the Croatian Parliament on 17 October 2003, promulgated by the President of the Republic on 24 October 2003 and had entered into force on 12 November 2003.

In September 2003, at the second session of the Assembly of States Parties, Ingrid Anticevic-Marinovic, Minister of Justice, Administration and Local Self-government of Croatia, said her country was undertaking the necessary adjustments of its legislation in order to create conditions for the implementation of the Rome Statue and to reinforce legal mechanisms guaranteeing complementarity between the national jurisdiction and the ICC.

In accordance with Article 139 of the Constitution, the Croatian Parliament ratified the Law on Ratification of the Rome Statute on 28 March 2001. The domestic law entered into effect on 5 April 2001. Croatia became the first Eastern European State to ratify the Rome Statute.

The constitutional issues arising from the immunities and surrender provisions of the Rome Statute were resolved prior to ratification.
