Djibouti ratified on 5 November 2002, becoming the 82nd State Party.

At a conference on ICC ratification in May 2002, senior government officials announced Djibouti's interest in prompt ratification of the Rome Statute. The Ministry of Justice prepared a draft law on the ICC.

President Ismael Omar Guelleh expressed strong support for the ICC at the UN Millennium Summit, stating that "we must activate and urgently use the new ICC, in order to make sure criminals who defy the laws are brought to justice."
