As of October 2003, it was not clear whether the government would move forward toward ratification.

On 2 January 2002, Minister of Justice Farouk Saif Al Nassr announced a "new project on the ratification of the ICC Statute" among 14 other legal initiatives aimed at reinforcing the domestic judicial system. According to the Justice Minister, the project clarified the constitutional and legislative requirements for the ratification and implementation of the Statute in the Egyptian legal order.
