> ICC Structure and Officials > Office of the Prosecutor Office of the Prosecutor Prosecutor Article 42 of the Rome Statute defines the functions of the Office of the Prosecutor (OTP). The Office of the Prosecutor must act independently as a separate organ of the Court and is to be headed by the Prosecutor. The Prosecutor has full authority over the management and administration of the Office, including the staff, facilities and other resources thereof. The Rome Statute provides that the Prosecutor is to be assisted by one or more Deputy Prosecutors and that the Prosecutor and the Deputy Prosecutors must be of different nationalities. Ms. Fatou Bensouda is the current Prosecutor of the ICC. The position of Deputy Prosecutor (Prosecutions) is currently vacant. Ms. Fatou Bensouda of Gambia was elected by consensus as Prosecutor of the ICC on 12 December 2011. Ms. Fatou Bensouda was sworn-in on 15 June 2012, in an open session of the Court, presided by Judge Sang-Hyun Song, At the time she takes office Ms. Bensouda will be responsible for overseeing the OTP’s activities in seven situations countries from which there are 15 cases in relation to 24 persons. One of her first tasks will be to represent the Office of the Prosecution in the confirmation of charges hearing in the case against Laurent Gbagbo (Gbagbo is the former President of Côte d’Ivoire and has been charged with crimes against humanity committed after the November 2010 elections). Mr. Luis Moreno-Ocampo was the first Prosecutor of the ICC from 16 June 2003 until 15 June 2012.
