URC - Togo and the Philippines
The Coalition for the International Criminal Court (CICC) is calling on the Republic of Togo and the Philippines to take the necessary steps to accede to and ratify the Rome Statute of the International Criminal Court (ICC) respectively. Increased ratifications of the Statute in the region will further strengthen the African voice at the Court and result in a more robust and meaningful participation in the global effort to establish a truly fair, effective and independent ICC.

To date, 31 states in Africa have already become states parties to the ICC (the most recent being the Republic of Seychelles in August 2010), and 15 others have signed the Rome Statute but have yet to complete the process of ratification.

As a new state party, Togo would consolidate the region as fully committed to the new system of international justice with this historic institution – the first permanent, independent court capable of investigating and bringing to justice individuals who commit the most serious violations of international humanitarian law, namely war crimes, crimes against humanity and genocide.

Je vous écris afin de vous prier d’utiliser vos bons offices afin d’accélérer le processus d’adhésion au Statut de Rome de la Cour pénale internationale. L’adhésion du Togo permettrait d’atteindre un plus grand nombre de ratifications du Statut dans la région et renforcerait la voix de l’Afrique au sein de la Cour. J’exhorte votre gouvernement à faire preuve d’une volonté politique nécessaire et de faire un pas historique en rejoignant la majorité des pays du monde qui ont ratifié le Statut de Rome.

À compter de janvier 2011, 114 pays ont ratifié ou adhéré au traité tandis que 139 en sont signataires. Ce nouveau système de justice, avec la Cour pénale internationale comme Pierre angulaire, est un important mécanisme permettant de garantir que les violations des droits de l’homme les plus graves ne restent plus impunies.

Le climat d’ouverture politique actuel dans votre pays, en plus des signes d’engagement envers la CPI comme indiqués par la participation du Togo aux dernières sessions de l’Assemblée des États parties du Statut de Rome de la CPI, a été accueilli favorablement par la communauté internationale. En outre, la détermination de votre gouvernement à traiter de la question de l’impunité est une preuve de son engagement à la justice internationale. J’ose espérer que vous ferez de votre volonté à combattre l’impunité une réalité en adhérant au Statut de Rome de la Cour pénale internationale au plus vite.

Votre Excellence, j’appelle donc le Togo à adhérer rapidement au Statut de Rome de la CPI en tant que signe de l’engagement du Togo à la lutte contre l’impunité, et à la justice et aux droits de l’homme.

The Coalition for the International Criminal Court (CICC) is calling on the Philippines and Togo to take the necessary steps to ratify and accede, respectively, to the Rome Statute of the International Criminal Court (ICC).

The Philippines actively took part in the 1998 United Nations Diplomatic Conference of Plenipotentiaries on the Establishment of an International Criminal Court held in Rome and became a signatory to the treaty on December 28, 2000.

Perpetrators of genocide, war crimes, and crimes against humanity must be held accountable. However, only seven states in Asia have presently ratified the Rome Statute. The Coalition encourages The Philippines to assert its commitment to the fight against impunity and to uphold the principles enshrined in the new system of international justice by promptly ratifying the Rome Statute of the ICC.

The Philippines’ ratification of the Rome Statute would strengthen the Asian voice and presence at the Court and assure that the ICC is enriched by the diverse legal cultures of the region.

Your Excellency,

I am writing to urge you to ensure The Philippine’s prompt ratification of the Rome Statute. The Philippines has been witness to the developments of the ICC since the Rome Conference - it actively engaged in the United Nations Diplomatic Conference of Plenipotentiaries on the Establishment of an International Criminal Court in 1998, and signed the Statute on December 28, 2000. Through these actions, your country demonstrated its commitment to the system of international justice enshrined in the Rome Statute of the ICC.

Your Excellency, throughout its nine years of existence, the Court has proven its invaluable contribution to the international rule of law and the fight against impunity. The Court’s current investigations in Uganda, Central African Republic, the Democratic Republic of Congo, Sudan and Kenya signify that it is moving forward in its crucial work to end impunity for genocide, crimes against humanity and war crimes. Furthermore, its preliminary examinations in Afghanistan, Colombia, Palestine, Cote d’Ivoire, Georgia, Nigeria, Honduras, Republic of Korea and Guinea are a clear manifestation of the wide scope of the Court’s jurisdiction.

With the recent ratifications of Bangladesh, St. Lucia, Seychelles and Moldova, 114 states are currently parties to the Rome Statute. However, the Asian region is still under-represented, with only seven states having ratified or acceded to the treaty. Thus, the support of Asian nations to the Court is crucial in order to contribute to a stronger representation of the region within the Court, as well as to pave the way toward universal ratification of the treaty.

I urge your Excellency to use your good offices to ensure The Philippines’ ratification to the Rome Statute as soon as possible.
