The Coalition for the International Criminal Court calls on Bahrain, Rwanda, and Thailand to join the Rome Statute of the ICC as soon as possible.

BAHRAIN

In the Middle East and North Africa (MENA) region, increased accessions and ratifications would further strengthen the global voice at the Court and result in a more robust and meaningful participation in the worldwide effort to establish a truly fair, effective, and independent ICC.

The MENA region is the most underrepresented region at the ICC. The Arab League, consisting of 22 states, has only 4 states parties to the Rome Statute – the Comoros Islands, Djibouti, Jordan, and Tunisia. Though underrepresented, the MENA region has a growing interest in the fight against impunity and the Coalition today has around 300 active member organizations spread across almost every country in the region. Through its strengthened regional efforts targeting civil society, parliamentarians, governments, media, and others, the Coalition is pushing for an increased number of accessions and ratifications and full implementation of the Rome Statute in MENA countries.


RWANDA

The Coalition calls on the government of Rwanda to take advantage of the current democratic momentum in Rwanda to accelerate its efforts to accede to the Rome Statute of the International Criminal Court (ICC).

Rwanda’s accession to the Rome Statute would strengthen the African voice at the Court and contribute to a robust and meaningful participation intended to ensure that the ICC upholds and abides by the spirit of the Rome Statute.


THAILAND

With three additional ratifications in Asia-Pacific (The Philippines, Maldives, and Vanuatu) in 2011, the region is showing a growing commitment to the Court. However, with only nine states having ratified or acceded to the Rome Statute, the region still remains under-represented. Twelve years after the adoption of the Rome Statute of the International Criminal Court, Asian states must heighten their ratification efforts and increase the region’s representation before the ICC.

Over the last decade, Thailand has taken a number of steps that have brought it closer to the Rome Statute system. On 2 October 2000, Thailand signed the Rome Statute and, over the next years, embarked on an internal process aimed at assessing compatibility of Thai domestic legislation with the Rome Statute, disseminating the work of the Court, and training government officials and lawmakers. The role of Thai civil society has been instrumental in this task, ensuring that ratification remained within the national debate despite fluctuating levels of support due to changing political scenarios.


The Coalition therefore appeals to Bahrain, Rwanda, and Thailand to ratify the Rome Statute and to fully support this first permanent, independent court capable of investigating and bringing to justice individuals who commit the most serious violations of international law, namely war crimes, crimes against humanity, and genocide.

Your Majesty:

I am writing to urge you to ensure Bahrain’s ratification of the Rome Statute of the ICC as soon as possible.

As you well know, the Rome Statute came into force in July 2002 and now has the support of nearly two-thirds the world’s nations. As of today, 121 States are parties to the Rome Statute. While this in itself is a remarkable achievement, continuing to secure universal ratfication of the Court remains an important objective so that the ICC is able to effectively ensure justice for grave crimes.

Your Majesty, throughout its ten years of existence, the Court has proven its invaluable contribution to the international rule of law and the fight against impunity. The Court's current investigations in Uganda, the Democratic Republic of Congo, Central African Republic, Sudan, Kenya, Libya, Cote d’Ivoire, and Mali signify that it is moving forward in its crucial work to end impunity for genocide, crimes against humanity and war crimes. Furthermore, its preliminary examinations in Afghanistan, Georgia, Guinea, Colombia, Honduras, Korea, and Nigeria are a clear manifestation of the wide scope of the Court's jurisdiction.

I urge your Majesty to use your good offices to ensure your country’s accession to the Rome Statute as soon as possible.

Your Excellency,

I am writing today to respectfully urge you and the Rwandan government to accede to the Rome Statute as soon as possible. With the political and social challenges facing Rwanda today, it is more important than ever to prioritize international justice and join the effort towards making the ICC an international tribunal that is truly fair, effective and independent.

Your participation was gladly noted at several sessions of the Assembly of State Parties of the ICC, as well as your attendance and contributions to debates and sessions during the first Review Conference of the Rome Statute, held in Kampala, Uganda from 31 May to 11 June 2010. While these signs of progress are certainly welcome, concrete steps towards accession have not yet been made. I would encourage you to take this participation further by actively speaking out about the vital importance of the rule of law and supporting action by the Rwandan government to accede to the Rome Statute of the ICC.

In doing so, Rwanda would send a strong message to the global community about its commitment to the pursuit of international justice. The ICC has been tirelessly dedicated to advocating for the rule of law in matters of conflict resolution and prevention, instead of resorting to armed violence. Accession to the Rome Statute would further indicate Rwanda’s commitment to the promotion of human rights and cooperation in international processes against heinous crimes.

Your Excellency, I strongly urge you to push forward the necessary legislation for acceding to and implementing the Rome Statute. Recognizing that the ICC works alongside national justice processes to complement them instead of replacing them, I support the continuance of this fight against impunity through joining the ICC. Despite various obstacles in this process, I am confident that strengthening the rule of law through the ICC is worth any challenges that may arise.

I urge Your Excellency to use your good offices to ensure Rwanda’s accession to the Rome Statute as soon as possible.

While the Asia region continues to be under-represented before the ICC, it is encouraging to note that among the latest ratifications to the Statute are the countries of The Philippines and Maldives, as well as Vanuatu in the Pacific. These recent ratifications are indeed an important illustration of Asia’s growing commitment to the system of international justice enshrined in the Rome Statute.

Thailand is a signatory to the Rome Statute and has taken a number of steps to move forward toward ratification despite the presence of some obstacles on this path. I am confident that through organizing ICC seminars as well ensuring the training of key stakeholders and lawmakers on the ICC, your government will be able to further address some of the legal challenges that have been raised in this process.
