Universal Ratification Campaign: Nepal
The Coalition for the International Criminal Court (CICC) calls on Nepal to take a major step forward in its commitment to international justice and the rule of law by acceding to the Rome Statute of the International Criminal Court (ICC) as soon as possible.

The passage of a House of Representatives resolution directing the Government to accede to the Rome Statute on 25 July 2006 signaled a major development in post-conflict Nepal. Since then, top politicians and leaders have met with ICC officials and CICC representatives and have publicly reiterated their intention to proceed promptly with accession to the ICC.

In joining the ICC, Nepal would further consolidate the rule of law and send a clear signal to the international community of its commitment to upholding the highest standards for international human rights.

Even with the recent ratification by Bangladesh, Asia remains poorly represented at the Court, and greater Asian participation is needed to ensure that the ICC is enriched by the diverse legal cultures of the region. Currently, there are 7 states parties from Asia (Bangladesh, Cambodia, East Timor, Republic of Korea, Mongolia, Afghanistan and Tajikistan). While Thailand and the Philippines have already signed the Rome Statute, they have yet to ratify. Nepal’s accession to the Rome Statute would further strengthen Nepal’s domestic human rights legislation while helping to bring Asian expertise to this landmark institution.

Your Excellency,

I am writing to urge you to ensure Nepal’s accession to the Rome Statute of the ICC as soon as possible. The Court’s investigations in Uganda, Central African Republic, the Democratic Republic of Congo, Kenya and Sudan signify that it is moving forward in its crucial work to end impunity for genocide, crimes against humanity and war crimes. Nepal’s support for this new and vital system of international justice by acceding to the Rome Statute is therefore of the utmost importance.

The Rome Statute came into force in July 2002 and now has the support of well over half of the world’s nations. As of April 2010, 111 states have ratified or acceded to the treaty, and 139 are signatories. The 111th state party is Bangladesh, the first South Asian country to embrace the treaty. While Bangladesh’s ratification is certainly instrumental in ensuring a larger representation of the Asia region at the ICC, Asian states are still underrepresented in the Treaty. Nepal’s accession to the Rome Statute would contribute immensely to your country’s objective to help end impunity and strengthen the rule of law.

Global support for the Rome Statute is crucial to building, strengthening, and ensuring the success of the first permanent, independent court capable of investigating and bringing to justice individuals who commit war crimes, crimes against humanity, genocide, and, once defined, the crime of aggression. Therefore, I urge your Excellency to use your good offices to ensure prompt treatment of the accession dossier as soon as possible, and by doing so express its ongoing support for justice and human rights.
