La Coalition pour la Cour pénale internationale (CCPI) appelle les Bahamas et Grenade à ratifier et à adhérer, respectivement, au Statut de Rome de la Cour pénale internationale (CPI).

Les États caribéens ont joué un rôle majeur dans la création et la mise en place d’une Cour pénale internationale. En 1989, lors de la 44ème Assemblée générale des Nations Unies, Trinité-et-Tobago a proposé d’ajouter à l’ordre du jour la question de la mise en place d’une cour pénale internationale pour qu’elle soit examinée par l’Assemblée. Cette motion – qui a été appuyée par un certain nombre d’États, y compris tous les États de la CARICOM – a donné lieu à une résolution, adoptée par consensus, appelant à la création d’une cour pénale internationale.

À ce jour, 114 États ont ratifié ou adhéré au système du Statut de Rome et seuls quatre États de la CARICOM doivent encore rejoindre la CPI : les Bahamas, Grenade, Haïti et la Jamaïque. Par conséquent, les États caribéens doivent ratifier le Statut de Rome de la Cour pénale internationale.

I am writing to urge you to ensure The Bahamas’ prompt ratification of the Rome Statute. The Caribbean region has been instrumental in the establishment and development of the Court. As you may recall, in 1989, during the United Nations’ 44th General Assembly, Trinidad and Tobago submitted an agenda item on the establishment of an international criminal court for the Assembly’s consideration. This motion – which gained the support of a number of states, including all CARCIOM member states – ultimately resulted in a consensus resolution that called for the creation of an international criminal court.

To date, 114 states have ratified the Rome Statute, and with the recent ratification of Saint Lucia in August 2010, only 4 CARICOM states, namely Bahamas, Grenada, Jamaica and Haiti, have yet to join the ICC. Global support, including that from the Caribbean’s region, to the Rome Statute system is crucial to building, strengthening, and ensuring the success of the first permanent, independent court capable of investigating and bringing to justice individuals who commit war crimes, crimes against humanity, genocide, and, once it enters into force, the crime of aggression.

Excellency, as you may be aware, the governing body of the ICC will hold elections in December 2011. As a non-state party, your country may provisionally nominate a candidate for one of six available judicial vacancies at the ICC when the nomination period opens on 13 June. It may also do so for the position of Chief Prosecutor, an historic election that will only take place for the second time in history. However, your nomination will only become effective if your instrument of ratification to the Rome Statute is deposited by 2 September 2011, the date the nomination period concludes.

I urge your Excellency to use your good offices to ensure The Bahamas’ ratification to the Rome Statute as soon as possible.

La Coalition pour la Cour pénale internationale (CCPI) appelle les Émirats arabes unis (EAU) à ratifier le Statut de Rome de la Cour pénale internationale (CPI) et l’Accord sur les privilèges et immunités de la Cour (APIC).

Un plus grand nombre de ratifications du Statut au Moyen-Orient et en Afrique du Nord (région MOAN) permettrait de renforcer la voix des États de cette région à la Cour et de leur assurer une place forte et significative dans l’effort mondial visant à établir une CPI juste, efficace et indépendante.

À ce jour, la région MOAN est la plus sous-représentée à la CPI. La Ligue arabe, constituée de 22 États, ne compte que 3 États parties au Statut de Rome : la Jordanie, Djibouti et les Comores. Néanmoins, neuf États ont signé le traité.

Bien qu’elle soit sous-représentée, la région MOAN est de plus en plus intéressée par la lute contre l’impunité et la Coalition compte à ce jour près de 250 organisations régionales actives réparties dans presque tous les pays de la région. En renforçant ses efforts de sensibilisation dans la région auprès de la société civile, des parlementaires, des gouvernements, des médias, etc., la Coalition espère augmenter le nombre d’adhésions et de ratifications au Statut de Rome ainsi que sa mise en œuvre dans les pays de la région MOAN.

La Coalition exhorte donc les Émirats arabes unis à ratifier le Statut de Rome et à soutenir pleinement cette première cour indépendante capable d’enquêter et de poursuivre les auteurs des violations du droit international les plus graves, à savoir les crimes de guerre, crimes contre l’humanité et génocide.

I am writing to urge you to ensure the United Arab Emirates’ (UAE) ratification of the Rome Statute of the ICC as soon as possible.

To date, 114 states have ratified the Rome Statute. Commendably, the United Arab Emirates signed the Rome Statute of the ICC on 27 November 2000, two years after the Treaty was finalized on 17 July 1998. The United Arab Emirates has closely followed the work of the ICC, more recently attending the 8th Session of the Assembly of State Parties (Nov 2009) and the Review Conference of the Rome Statute (June 2010) and actively participating in both.

The Middle East and North Africa (MENA) region is underrepresented in the ICC. The League of Arab States has but three members that are states parties to the Rome Statute, although nine have signed it.

While the region may currently be the most underrepresented, the region is making unprecedented advances. On 19 February 2011, Interim President H.E. Mr. Foued Mebazaa’s adopted a decree law approving Tunisia’s accession to the Rome Statute. Kuwait has repeatedly stated its intention to ratify the Rome Statute, most recently when it replied on 13 September 2010 to the recommendations made by the United Nations Human Rights Council Universal Periodic Review regarding the Rome Statute, stating that "its ratification by the concerned authorities is underway.”

Global support, including that from the region, to the Rome Statute system is crucial to building, strengthening, and ensuring the success of the first permanent, independent court capable of investigating and bringing to justice individuals who commit war crimes, crimes against humanity, genocide, and, once it enters into force, the crime of aggression.
