The Coalition for the International Criminal Court calls on Ukraine and Cameroon to join the Rome Statute of the ICC as soon as possible.

UKRAINE

42 states in Europe and Central Asia are parties to the Rome Statute, 27 of which are European Union (EU) members. However, 12 others still remain outside the system.

A signatory to the Rome Statute since 20 January 2000, Ukraine became the first non-state party to accede to the Agreement on Privileges and Immunities of the Court (APIC) on 29 January 2007. However, like five of its neighbors (Armenia, Kyrgyzstan, the Principality of Monaco, the Russian Federation, and Uzbekistan), Ukraine has yet to complete the process of ratification.

This is in part due to a 2001 ruling by the Ukrainian Constitutional Court which found the Rome Statute to be incompatible with the constitution.. As the Constitution also requires that international treaties that are not in conformity with the Constitution may not be concluded until appropriate amendments have been made to the latter, The current constitutional review process should be seized as an opportunity to address this obligation and thus overcome the only legislative obstacle to ratification.

In the 2011 EU-Ukraine Association Agenda, both parties agreed on the need to “effectively implement all measures necessary for the entry into force for Ukraine of the Rome Statute establishing the ICC.” On 30 March 2012, the European Union and Ukraine initialed the text of the EU-Ukraine Association Agreement which also includes provisions relating to ratification and implementation of the Rome Statute and cooperation with the ICC. The Agreement is expected to be signed in late 2013.

The Coalition calls on Ukraine to take the necessary steps to ratify the Rome Statute. Increased ratifications of the Statute will further strengthen the global voice at the Court and result in a more robust and meaningful participation in the global struggle to establish a truly fair, effective and independent ICC.

CAMEROON

The Coalition calls on the government of Cameroon to take advantage of the recent ratification efforts regarding other international conventions to accelerate its efforts to ratify the Rome Statute of the International Criminal Court (ICC), By ratifying, Cameroon would accept the Court’s jurisdiction over its territory and its nationals, as a Court of last resort.

Cameroon’s ratification of the Rome Statute would strengthen the African voice at the Court and make it the 34th African state party. In addition, Cameroon would have the opportunity to participate in the ICC’s processes, and ensure that the ICC upholds and abides by the spirit of the Rome Statute.

FOR UKRAINE

Write a letter to H.E. Mr. Viktor Yanukovych, President of Ukraine, to encourage his government to accede to the Rome Statute of the ICC.

I am writing to urge you to ensure Ukraine’s ratification of the Rome Statute of the ICC as soon as possible.
Your Excellency, the International Criminal Court is an important mechanism for ensuring that the most serious violations of human rights no longer go unpunished. The Court’s current investigations in the Democratic Republic of Congo, Uganda, Darfur (Sudan), Central African Republic, Kenya, Libya, Cote d’Ivoire, and Mali signify that it is moving forward in its crucial work to end impunity for genocide, crimes against humanity and war crimes. Furthermore, its preliminary examinations in Afghanistan, Colombia, Georgia, Guinea, Honduras, Nigeria, and South Korea are a clear manifestation of the wide scope of the Court’s jurisdiction.

Today the Rome Statute counts 122 States Parties – nearly two thirds of the world’s nations – but a number of countries, including Ukraine, remain outside the system and are thus unable to benefit from the protection and redress it offers.

Your Excellency, Ukraine should join in the determination to put an end to impunity for the crimes of genocide, crimes against humanity, and war crimes, by adhering to the system of international justice created by the Rome Statute.
I therefore urge Your Excellency to take the necessary steps to ratify the Rome Statute without delay in keeping with Ukraine’s affirmed support for human rights and the rule of law.

Your Excellency,

I am writing to urge you to ensure Cameroon’s ratification to the Rome Statute of the ICC as soon as possible.  Cameroon’s support for the ICC which is a vital system of international justice through the ratification of the ROME STATUTE is of utmost importance given the preponderant role Cameroon plays within the Central African sub-region in particular and Africa in General. It is also of importance with regards to Cameroon’s international engagements.

As you well know, the Rome Statute came into force in July 2002 and now has the support of more than half of the world’s nations. As of today, 122 States have ratified the Rome Statute amongst which are 32 African Countries. While this in itself is a remarkable achievement, continuing to secure universal acceptance of the Court remains an important objective to ensure that the ICC is able to effectively obtain justice for grave crimes no matter where they occur.

I welcome the continuous engagement of your country with the ICC and the international justice system, which has been reflected amongst others by Cameroon’s hosting of an ICC regional seminar in October 2010. Cameroon’s recent ratification of U.N Conventions on Corruption and Child Trafficking and the increased fight against impunity are additional indications that Cameroon s on the right path and needs to immediately ratify the Rome Statute.

Excellency, I encourage you and your government to submit a bill of accession to Parliament without delay and fully align Cameroonian legislation with all the provisions under the Rome Statute in order to become an important part of this much-needed international justice system.
