The Coalition for the International Criminal Court (CICC) is calling on Egypt to take the necessary steps to accede to the Rome Statute of the International Criminal Court (ICC). Increased accessions and ratifications of the Statute in the Middle East and North Africa (MENA) region will further strengthen the global voice at the Court and result in a more robust and meaningful participation in the global struggle to establish a truly fair, effective, and independent ICC.

To date, the MENA region is the most underrepresented region at the ICC. The Arab League, consisting of 22 Arabic-speaking states, has only 3 States Parties to the Rome Statute – Jordan, Djibouti, and the Comoros Islands. The MENA region also has 11 signatories (Algeria, Bahrain, Egypt, Iran, Israel, Kuwait, Morocco, Oman, Syria, UAE and Yemen). Egypt signed the Rome Statute on 26 December 2000 and the Egyptian Coalition for the International Criminal Court was formed in Cairo in January 2008, bringing the total number of ICC Coalitions in the MENA region to eleven.

The region has a growing human rights movement and the Coalition today has over 300 active member organizations spread across almost every country in the region. Through its strengthened regional efforts targeting civil society, parliamentarians, governments, media, and others, the Coalition is pushing for an increased number of accessions and ratifications and full implementation of the Rome Statute in the MENA region.
The Coalition therefore appeals to Egypt to accede to the Rome Statute and to fully support this first permanent, independent court capable of investigating and bringing to justice individuals who commit the most serious violations of international law, namely war crimes, crimes against humanity, and genocide.

Your Excellency:

I am writing to urge you to ensure Egypt’s ratification of the Rome Statute of the International Criminal Court (ICC) as soon as possible. The Court’s first investigations in Uganda, Central African Republic, the Democratic Republic of Congo and Sudan signify that it is moving forward in its crucial work to end impunity for genocide, crimes against humanity, and war crimes. Egypt’s support for this new and vital system of international justice by acceding to the Rome Statute is therefore of utmost importance.
At the Non-Aligned Movement (NAM) Ministerial Meeting Outcome Document of 27-30 April 2009, NAM States Parties to the Rome Statute of the ICC called upon those States, which have not yet done so, to consider to ratifying or acceding to the Rome Statute of the ICC. Egypt is a founding member of NAM.
I also call your attention to the humanitarian situation in the Sudan. We applaud the support Egypt and the League of Arab States has shown to securing peace in Sudan. However, we urge against an inappropriate use of an Article 16 deferral, which only delays justice for the victims.
Commendably, Egypt signed the Rome Statute of the ICC on 26 December 2000. As you well know, the Rome Statute came into force in July 2002 and today, 108 states have acceded to or ratified the ICC Treaty; and 139 are signatories. The new system of international justice represented by the ICC is an important tool that will ensure that the most serious international crimes no longer go unpunished. Arab nations are instrumental in building and strengthening this new justice system, and their support to the ICC is vital to its success and efficiency and its fight against impunity.
Egypt should ratify as soon as possible and fully align its legislation with all obligations under the Rome Statute, including ratification of the Agreement on Privileges and Immunities of the ICC. It should join the rest of the world in the determination to cooperate for the prevention of genocide, crimes against humanity, and war crimes and to put an end to impunity of perpetrators thereof, by adhering to the new system of international justice created by the Rome Statute.
