The Coalition for the International Criminal Court calls on Egypt and Thailand to ratify the Rome Statute of the ICC as soon as possible.

In the Middle East and North Africa (MENA) region, increased accessions and ratifications would further strengthen the global voice at the Court and result in a more robust and meaningful participation in the worldwide effort to establish a truly fair, effective, and independent ICC.

The MENA region is the most underrepresented region at the ICC. The Arab League, consisting of 22 states, has only 4 states parties to the Rome Statute – the Comoros Islands, Djibouti, Jordan, and Tunisia. Though underrepresented, the MENA region has a growing interest in the fight against impunity and the Coalition today has around 250 active member organizations spread across almost every country in the region. Through its strengthened regional efforts focusing on civil society, parliamentarians, governments, media, and others, the Coalition is pushing for an increased number of accessions and ratifications and full implementation of the Rome Statute in MENA countries.

With two additional ratifications in Asia-Pacific (The Philippines and Maldives) in 2011, the region is showing a growing commitment to the Court. Still, it remains under-represented with only nine states having ratified or acceded to the Rome Statute. Twelve years after the adoption of the Rome Statute of the International Criminal Court, Asian states must heighten their ratification efforts and increase the region’s representation before the ICC.

Over the last decade, Thailand has taken a number of steps that have brought it closer to the Rome Statute system. On 2 October 2000, Thailand signed the Rome Statute and, over the next years, embarked on an internal process aimed at assessing compatibility of Thai domestic legislation with the Rome Statute, disseminating the work of the Court, and training government officials and lawmakers. The role of Thai civil society has been instrumental in this task, ensuring that ratification remained within the national debate despite fluctuating levels of support due to changing political scenarios.

The Coalition therefore appeals to Egypt and Thailand to ratify the Rome Statute and to fully support this first permanent, independent court capable of investigating and bringing to justice individuals who commit the most serious violations of international law, namely war crimes, crimes against humanity, and genocide.

Your Excellency,

I am writing to urge you to ensure Egypt’s ratification of the Rome Statute of the ICC as soon as possible.

As you well know, the Rome Statute came into force in July 2002 and now has the support of nearly two thirds of the world’s nations. With Guatemala’s accession to the Rome Statute on 2 April 2012, 121 states have now acceded to or ratified the treaty. Continuing to secure universal acceptance of the Court remains an important objective that will ensure that the ICC is able to operate effectively in combatting impunity for war crimes, crimes against humanity, and genocide.

On 6 March 2011, during former International Court of Justice Judge Nabil El Arabi’s tenure as Foreign Minister of Egypt, he mentioned that ratification of the Rome Statute should be a priority. Today, the situation in Egypt offers important opportunities to reassess the country’s efforts to bridge the gap between national and international commitments to rule of law standards and their implementation and enforcement. In light of the parliamentary elections and the upcoming presidential elections, now is the time for Egypt to display its commitment to justice and the rule of law by joining the ICC.

Your Excellency, throughout its ten years of existence, the Court has proven its invaluable contribution to the international rule of law and the fight against impunity. The Court's current investigations in Uganda, Central African Republic, the Democratic Republic of Congo, Sudan, Kenya, Libya and Cote d’Ivoire signify that it is moving forward in its crucial work to end impunity for genocide, crimes against humanity and war crimes. Furthermore, its preliminary examinations in Afghanistan, Colombia, Palestine, Georgia, Nigeria, Honduras, Republic of Korea and Guinea are a clear manifestation of the wide scope of the Court's jurisdiction.

I urge your Excellency to use your good offices to ensure Egypt’s ratification of the Rome Statute as soon as possible.

I am writing to you to respectfully call on your government to promptly ratify the Rome Statute of the International Criminal Court. While the Asia region continues to be under-represented before the ICC, it is encouraging to note that among the latest ratifications to the Statute are the countries of The Philippines and Maldives, as well as Vanuatu within the Pacific. These recent ratifications are indeed an important illustration of Asia’s growing commitment to the system of international justice enshrined in the Rome Statute.

Thailand is a signatory to the Rome Statute and has taken a number of steps to move forward toward ratification despite the presence of some obstacles on this path. An in-depth debate on ratification within the Thai government has led it to organize important ICC seminars as well as to ensure the training of key stakeholders and lawmakers on the ICC. I am confident that through these initiatives, your government will be able to further address some of the legal challenges that have been raised in this process.
