La Coalición por la Corte Penal Internacional le solicita a Egipto y Tailandia que se unan al Estatuto de Roma de la CPI lo antes posible.

Lograr más ratificaciones y adhesiones en Oriente Medio y África del Norte le dará a los Estados una mayor capacidad para participar en la labor de la Corte. Del mismo modo, nuevas ratificaciones y adhesiones ayudarán a la Corte en su objetivo de lograr una mayor imparcialidad, efectividad e independencia.

El MOAN es la región menos representada en la Corte. De la Liga Árabe, a la que pertenecen 22 Estados, sólo cuatro son Estados Partes al Estatuto de Roma: las Islas Comoras, Yibuti, Jordania y Túnez. Sin embargo, pese a su escasa representación, se observa una creciente voluntad regional de participar en la lucha contra la impunidad. La Coalición cuenta hoy en día con alrededor de 250 organizaciones miembros que operan prácticamente en cada uno de los Estados de la región. Al concentrar su labor regional en la sociedad civil (incluyendo a los gobernantes, parlamentarios y a los medios de comunicación), la Coalición procura lograr más incorporaciones al tratado y así la plena aplicación del Estatuto de Roma dentro de los Estados de la región.

Con dos nuevas ratificaciones en Asia-Pacífico (Filipinas y Maldivas) en 2011, la región está demostrando un gran compromiso con la Corte. Sin embargo, aún cuenta con una baja representación con sólo nueve Estados que han ratificado o adherido al Estatuto de Roma. Doce años después de la adopción del Estatuto de Roma de la Corte Penal Internacional, los Estados asiáticos deben intensificar sus esfuerzos en torno a la ratificación y aumentar la representación de la región en la CPI.

En la última década, Tailandia ha realizado numerosos pasos hacia la aceptación del sistema del Estatuto de Roma. El 2 de octubre de 2000, Tailandia firmó el Estatuto de Roma y, en los años subsiguientes, se embarcó en un proceso interno para evaluar la compatibilidad del Estatuto de Roma con las leyes nacionales tailandesas, diseminar el trabajo de la Corte y entrenar a funcionarios gubernamentales y profesionales del derecho. El papel de la sociedad civil tailandesa ha sido instrumental a la hora de asegurar que la ratificación del tratado permanezca dentro del debate nacional más allá de los cambiantes niveles de apoyo generados por los diversos escenarios políticos.

Por estos motivos, la Coalición quiere pedirle a Egipto y a Tailandia que ratifiquen el Estatuto de Roma y que se comprometan activamente con la primera corte permanente e independiente capaz de investigar y llevar ante la justicia a los culpables de las más serias violaciones al derecho internacional, a saber, crímenes de guerra, crímenes de lesa humanidad y genocidio.

Your Excellency,

I am writing to urge you to ensure Egypt’s ratification of the Rome Statute of the ICC as soon as possible.

As you well know, the Rome Statute came into force in July 2002 and now has the support of nearly two thirds of the world’s nations. With Guatemala’s accession to the Rome Statute on 2 April 2012, 121 states have now acceded to or ratified the treaty. Continuing to secure universal acceptance of the Court remains an important objective that will ensure that the ICC is able to operate effectively in combatting impunity for war crimes, crimes against humanity, and genocide.

On 6 March 2011, during former International Court of Justice Judge Nabil El Arabi’s tenure as Foreign Minister of Egypt, he mentioned that ratification of the Rome Statute should be a priority. Today, the situation in Egypt offers important opportunities to reassess the country’s efforts to bridge the gap between national and international commitments to rule of law standards and their implementation and enforcement. In light of the parliamentary elections and the upcoming presidential elections, now is the time for Egypt to display its commitment to justice and the rule of law by joining the ICC.

Your Excellency, throughout its ten years of existence, the Court has proven its invaluable contribution to the international rule of law and the fight against impunity. The Court's current investigations in Uganda, Central African Republic, the Democratic Republic of Congo, Sudan, Kenya, Libya and Cote d’Ivoire signify that it is moving forward in its crucial work to end impunity for genocide, crimes against humanity and war crimes. Furthermore, its preliminary examinations in Afghanistan, Colombia, Palestine, Georgia, Nigeria, Honduras, Republic of Korea and Guinea are a clear manifestation of the wide scope of the Court's jurisdiction.

I urge your Excellency to use your good offices to ensure Egypt’s ratification of the Rome Statute as soon as possible.

Your Excellency,

I am writing to you to respectfully call on your government to promptly ratify the Rome Statute of the International Criminal Court. While the Asia region continues to be under-represented before the ICC, it is encouraging to note that among the latest ratifications to the Statute are the countries of The Philippines and Maldives, as well as Vanuatu within the Pacific. These recent ratifications are indeed an important illustration of Asia’s growing commitment to the system of international justice enshrined in the Rome Statute.

Thailand is a signatory to the Rome Statute and has taken a number of steps to move forward toward ratification despite the presence of some obstacles on this path. An in-depth debate on ratification within the Thai government has led it to organize important ICC seminars as well as to ensure the training of key stakeholders and lawmakers on the ICC. I am confident that through these initiatives, your government will be able to further address some of the legal challenges that have been raised in this process.

Your Excellency, throughout its nearly ten years of existence, the Court has proven its invaluable contribution to the international rule of law and the fight against impunity.
