The Coalition for the International Criminal Court (CICC) is calling on the Republic of Indonesia to deliver on its commitment to fight impunity by acceding to the Rome Statute, the founding treaty of the International Criminal Court (ICC). Indonesia's accession to the Rome Statute would not only contribute toward strengthening Asia's voice at the Court, but, given Indonesia's important role in Asia, it would also set an important example for other countries in the region that have yet to join the ICC.

To date, the Asia-Pacific region is one of the most underrepresented regions in the ICC. One hundred and sixteen states have ratified or acceded to the Rome Statute, but only seven states in Asia have presently joined the ICC: Afghanistan, Bangladesh, Cambodia, Japan, the Republic of Korea, Mongolia and Timor-Leste. Furthermore, seven states in the Pacific have joined the Court (Australia, Cook Islands, Fiji, Marshall Islands, Nauru, New Zealand and Samoa). It is therefore imperative that Asian states take the necessary steps in joining this global fight against impunity.

Noting that Indonesia has included accession to the Rome Statute within its National Plan of Action on Human Rights(RANHAM 2011-2014), the Coalition has chosen the month of July to call on Indonesia to move forward with its accession process.

Your Excellency,

I am writing to call on your government to take the necessary steps to accede to the Rome Statute of the International Criminal Court (ICC) as soon as possible. As the world's first permanent international court to prosecute war crimes, crimes against humanity, and genocide, the ICC is the cornerstone of a groundbreaking system that maintains that there can be no impunity for the worst crimes. To date, 116 states have joined the Court, and other states such as Malaysia, Maldives and the Philippines are nearing completion in their ratification or accession processes. While it is encouraging to note that more Asian states are taking the necessary steps to join the ICC, currently only 14 states within Asia and the Pacific have ratified the Rome Statute, leaving this region significantly underrepresented at the Court.
Excellency, Indonesia remains a key actor in Southeast Asia. As the new chair of the Association of Southeast Asian Nations (ASEAN), Indonesia's accession to the Rome Statute would set a strong example for the remaining ASEAN member states which, with the exception of Cambodia, have yet to ratify the Rome Statute.

Furthermore, as a state party, Indonesia would be able to actively participate in the annual Assembly of States Parties (ASP) of the ICC during which states make important decisions in relation to the administration of the Court. Additionally, in December 2011, six new judges, a new chief prosecutor and other Court officials will be elected by the ASP. By acceding to the treaty by 2 September 2011, Indonesia can nominate and vote for candidates to these important posts to ensure national and regional representation at the ICC.

I urge your Excellency to use your good offices to ensure Indonesia's accession to the Rome Statute as soon as possible.
