The Coalition for the International Criminal Court calls on Indonesia and Ukraine to join the Rome Statute of the ICC as soon as possible.

INDONESIA

As the world celebrates the tenth anniversary of the Court this month, the Coalition calls on Indonesia to join the global movement of international justice and meet the target set in its National Human Rights Plan of Actions regarding Rome Statute accession.

By joining the Court, Indonesia would strengthen the Asian voice within the system, and send a clear message within and across its borders that it is committed to ending impunity in the country as well as preventing gross human rights violations from happening again.

UKRAINE

After having signed the Rome Statute on 20 January 2000, Ukraine became the first non-state party to accede to the Agreement on Privileges and Immunities of the Court (APIC) on 29 January 2007.

While Ukraine has reiterated its commitment to international justice on numerous other occasions, the country has yet to ratify the Rome Statute. This is in part due to the Constitutional Court’s ruling in 2001 whereby amendment of the Constitution was deemed necessary prior to ratification. However, the Constitutional Assembly established recently to consider possible amendments to the Constitution could address the obstacles highlighted in the 2001 ruling, paving the way for Ukraine’s ratification of the Rome Statute.

Including Ukraine, the region of Europe/Central Asia has six signatories to the Rome Statute that have yet to complete the process of ratification (Armenia, Kyrgyzstan, the Principality of Monaco, the Russian Federation, and Uzbekistan). Another 42 states in Europe and Central Asia are parties to the Rome Statute, 27 of which are European Union (EU) members.

The Coalition calls on Ukraine to take the necessary steps to ratify the Rome Statute. Increased ratifications of the Statute will further strengthen the global voice at the Court and result in a more robust and meaningful participation in the global struggle to establish a truly fair, effective and independent ICC.

As states parties, Indonesia and Ukraine would be able to actively participate in a more significant manner in the annual Assembly of States Parties (ASP) of the ICC during which states make important decisions in relation to the administration of the Court, including the election of judges, prosecutors, and other Court officials.

The Coalition therefore appeals to Indonesia and Ukraine to join the Rome Statute and to fully support the first permanent, independent court capable of investigating and bringing to justice individuals who commit the most serious violations of international law, namely war crimes, crimes against humanity, and genocide.

Your Excellency:

I am writing to urge you to ensure Indonesia’s accession to the Rome Statute of the ICC as soon as possible. 2012 marks the tenth anniversary of the Court, truly a celebration of a landmark institution which, despite various obstacles and challenges, is one of the most important achievements in international law together with the establishment of the United Nations. During these ten years, the different organs of the Court – along with the incessant assistance and monitoring of civil society across the world – have had the tremendous task not only of creating a system aimed at putting an end to impunity for the gravest crimes, but also of initiating investigations and bringing alleged authors of these crimes to justice.

The Court’s investigations in Uganda, Central African Republic, the Democratic Republic of Congo, Darfur (Sudan), Kenya, Libya and Cote d’Ivoire signify that it is moving forward in its crucial work to end impunity for genocide, crimes against humanity and war crimes. The system of international justice represented by this historic institution is thus a crucial tool in ensuring that the most serious international crimes no longer go unpunished.

Asian nations are instrumental in building and strengthening this new justice system, and their support to the ICC is vital to its success and efficiency. With The Philippines’, Maldives and Vanuatu’s recent ratifications, it is clear that the Asia region is taking the proper steps toward increasing its representation within the Rome Statute system.

By acceding to the Rome Statute, you will be expressing Indonesia’s commitment to global justice and the rule of law.

I urge your Excellency to use your good offices to ensure Indonesia’s accession to the Rome Statute as soon as possible.

Your Excellency,

I am writing to urge you to ensure Ukraine’s ratification of the Rome Statute of the ICC as soon as possible.

Your Excellency, throughout its ten years of existence, the International Criminal Court has proven its invaluable contribution to the international rule of law and the fight against impunity. The Court’s current investigations in Uganda, Central African Republic, the Democratic Republic of Congo, Sudan, Kenya, Libya, and Cote d’Ivoire signify that it is moving forward in its crucial work to end impunity for genocide, crimes against humanity, and war crimes. Furthermore, its preliminary examinations in Afghanistan, Colombia, Georgia, Nigeria, Honduras, Republic of Korea, and Guinea are a clear manifestation of the wide scope of the Court’s jurisdiction. Today the Rome Statute counts 121 States Parties – more than half the world’s nations – while 139 are signatories, including Ukraine.

This new system of international justice, with the International Criminal Court as a cornerstone, is an important mechanism in ensuring that the most serious violations of human rights no longer go unpunished. Ukraine’s support for this system by ratifying the Rome Statute is therefore of utmost importance. This year, we are commemorating the 10th anniversary of the International Criminal Court, and I urge you to accelerate your efforts towards ratification in honor of this milestone.

Commendably, Ukraine signed the Rome Statute on 20 January 2000, less than two years after the treaty was finalized on 17 July 1998. Ukraine also became the first non-state party to accede to the Agreement on Privileges and Immunities of the Court (APIC) on 29 January 2007. In 2009, Ukraine approved the EU-Ukraine Association Agenda to prepare and facilitate the implementation of the EU-Ukraine Association Agreement, a document that includes reference to the ICC and the need for Ukraine to effectively implement all measures necessary for the entry into force of the Rome Statute. Ukraine has also shown a level of commitment to the ICC by attending several sessions of the Assembly of States Parties as well as the 2010 Review Conference in Kampala, Uganda.

Your Excellency, Ukraine should join the rest of the world in the determination to cooperate for the prevention of genocide, crimes against humanity and war crimes and to put an end to impunity of perpetrators thereof, by adhering to the new system of international justice created by the Rome Statute. I therefore urge Ukraine to take the necessary steps to ratify the Rome Statute without delay as a demonstration of its commitment to fight impunity and its ongoing support for justice and human rights.
