The Coalition for the International Criminal Court calls on Brunei Darussalam to join the Rome Statute of the ICC as soon as possible.

As the world celebrates the tenth anniversary of the International Criminal Court, the Coalition calls on the government of Brunei Darussalam to join fellow ASEAN states Cambodia, The Philippines and Timor-Leste, in addition to 17 other states parties in Asia and the Pacific, in joining the ICC.

Through this commitment to the global fight against impunity, the government of Brunei Darussalam would contribute to strengthening both ASEAN’s and Asia-Pacific’s voice within the ICC and set an important example for other states in the region that have yet to ratify or accede to the Rome Statute.

Please note that any letter that you or anyone else outside the CICC Secretariat sends as part of this campaign should be written in an individual capacity or on behalf of your organization, not on behalf of the Coalition for the ICC. This policy should also be observed by members of national or regional coalitions of the CICC.

Write a letter to His Majesty, Sultan Hassanal Bolkiah, Sultan of Brunei Darussalam, to encourage his government to accede to the Rome Statute of the ICC.

Your Majesty,

I am writing to respectfully call on your government to consider Brunei Darussalam’s prompt accession to the Rome Statute of the ICC. 2012 marks the tenth anniversary of the Court, truly a celebration of a landmark institution which, despite various obstacles and challenges, is one of the most important achievements in international law together with the establishment of the United Nations. With 121 State Parties, following the most recent accession by Guatemala in April 2012, and the Court’s seven open investigations in the Central African Republic, Cote d’Ivoire, Darfur, the Democratic Republic of the Congo, Kenya, Libya, and Uganda, the support of the international community is today more crucial than ever. The ICC has become a major pillar of international justice, aiming to ensure that the most serious international crimes do not go unpunished.

While the Asia-Pacific region remains underrepresented in the Court, it must be noted that the recent ratifications have been done by The Philippines, Vanuatu and Maldives. In addition, Malaysia, Tonga and Vanuatu continue to move forward in their ratification processes. Brunei Darussalam’s accession would contribute significantly in increasing ASEAN’s voice at the ICC, as well as encouraging other Asia-Pacific states to join this global movement for international justice.

The Rome Statute - the founding treaty of the ICC - is based upon the principle of complementarity as a core principle, underlining the primary role of states in investigating and prosecuting gross human rights violations, and establishing that the ICC will only act when states are unwilling or unable to carry out said prosecutions. In addition, the principle of non-retroactivity ensures that the ICC will not investigate alleged crimes committed in a state prior to the entry into force of the Rome Statute.

Your Majesty, in this tenth anniversary of the ICC, I respectfully call on your majesty to consider Brunei Darussalam’s accession to the Rome Statute at your earliest convenience.
